MINUTES OF THE MEETING OF THE HOLBROOK PARISH COUNCIL HELD AT THE “ARKWRIGHT” PARISH HALL ON WEDNESDAY 26th AUGUST 2009 AT 7.15.p.m.

OPEN FORUM
Parish Plan next meeting on 8th September. At present there are five projects running. Makeney Road footpath – ongoing. Village Website – ongoing. Mellors Lane play area – two applications submitted to the Big Lottery for (1) Youth Shelter and (2) Equipment – swings etc. Both have been acknowledged and being considered. Village SOS – application submitted, acknowledged and awaiting further instructions. Shop enquiry – still going on. They are considering an application to the Trust House Forte organization but await the result from the Big Lottery. A meeting is to be held with D.R.C.C. re Insurance, Health & Safety and Child Protection issues. Liaison is being maintained with A.V.B.C. and D.C.C.
Concern was expressed regarding the proposed play area at the “Spotted Cow” - access from The Paddock and noise. It was pointed out that this was an offer made by the Landlord and that discussions re a suitable site are still ongoing with A.V.B.C. Also discussions are still taking place with the D.C.C. re protected parking on Mellors Lane.
Portway traffic – signs were to be placed outside “Top Cottage” until resident asked for them to be moved slightly.
Police – Neighbourhood Watch co-ordinator has stepped down. P.C.S.O. John Midgley has contacted the street co-ordinators who want to continue – meeting to be arranged. Burglary at Boothswood Farm which is under renovation. Chapel Street parking – owner of the white van has been asked to leave further away from the junction. Police are also speaking to the pub landlords about the parking situation on Chapel Street. There is also a problem with vehicles being parked on the kerb outside the cottages on Makeney Road – to be followed up.

Councillor vacancy – Statement as to Persons Nominated have been posted on the Parish Noticeboards – three candidates – J.P. Banks, D.G. Bower and P.L. White.

The Minutes of the previous meeting held on 29th July 2009 were accepted as a true record proposed Councillor Mrs. Smith seconded Councillor Mrs.Bott – unanimously agreed.
MATTERS ARISING
2009/8/1 Proposed Trust for New Parish Hall:- Public Meeting 6th August – 76.9 were in favour (75% of those present and able to vote was required). David Bower had queried the vote following the meeting with regard to abstentions – abstentions do not count. Approximately 100 people attended the meeting. The Chairman thanked everyone who had supported. All documents have now gone to the Charity Commission. The following resolutions were put before the meeting:-
1) That the net sum of £7,500 from the funds earmarked by the Parish Council for the Holbrook Arkwright Hall Village Community Centre be paid to the Parish Council’s Solicitors (FlintBishopLLP of Derby) to enable them to pay the balancing sum between the consideration for the surrender of the said Lease date 12th October 1982 and the acquisition of the freehold of the land and buildings comprised in the said Lease and to formally complete the transactions.
Proposed Councillor Rhodes, seconded Councillor Hall – unanimous.
2) That a further sum from the funds earmarked by the Parish Council for the Holbrook Arkwright Hall Village Community Centre be paid to FlintBishopLLP to pay the costs and disbursements of the Derby Diocesan Board of Finance Limited consisting of :
(a) James Battie of Geldards £1500 plus VAT either at 17.5% or 15% total either £1762.50 or £1725
(b) John Farquhar FRICS £200 plus VAT of £30 total £230
(c) Boxall Brown and Jones £325 plus VAT at 17.5% total £381.88
(d) Eddowes & Waldron £2,400 plus VAT at 15% and disbursements of £12 total £2782
Total including recoverable VAT £5,156.38 or £5,118.88
Proposed Councillor Hall, seconded Councillor Ms. Morral – unanimous.
3) That the Deed of Surrender and Transfer of the land and buildings comprised in the said Lease dated 12th October 1982 be approved and signed in accordance with Minute 2009/7/1 of the 29th July 2009 and returned to FlintBishopLLP in order to complete the transactions.
Proposed Councillor Hunt, seconded Councillor Mrs. Smith – unanimous.
The Chairman asked D.C.C. Councillor MacDonald for his support with regard to the access issues – Councillor Mike Longdon (D.C.C. Cabinet Member for Children and Young People) has contacted the Chairman and a meeting is to be arranged. It was stressed we all need to work together for the benefit of the residents of Holbrook. Councillor MacDonald is very supportive.

2009/8/2 Mellors Lane Playing Field:- The Clerk had received an e-mail from Iris Brien (Parish Plan secretary) forwarding an e-mail from A.V.B.C. stating that providing a change of use of the land is not involved, the shelter is ancillary to the use of the land and it is not greater than 4 metres in height or 200 cubic metres in capacity, planning permission will not be required. Discussions are ongoing with the landowner and D.C.C. re path on Mellors Lane to the playing field. The Chairman had received an e-mail from Dan Bradshaw (Young Peoples’ Group Parish Plan) asking for a cheque for £753 to cover the cost of goal posts. The Clerk had asked Dan for an Invoice showing V.A.T. etc.
2009/8/3 Bus Shelter – Town Street:- Following further discussions with the D.C.C. it had been found that the footway is not wide enough to accommodate a new shelter and a previous suggestion of putting one on the island to serve both directions is again under consideration. A question was raised as to whether a wooden shelter, with only legs and a roof could be situated on Town Street. A further question was raised with regard to the location of the bus stop at the Moorside Lane/Pond Road/Town Street junction. Action – Councillor Bott
2009/8/4 Traffic Action Plan :- – Nothing to report.
2009/8/5 Killis Lane :- Community Governance Review going ahead. Statutory notices had been posted and any comments/representations should be submitted to A.V.B.C. no later than noon on 27th August.
2009/8/6 “Spotted Cow Play Area :- Nothing further to report.
2009/8/7 Village Activities:- Councillor Biggin reported that attendance on the Village Walks had declined, however, others are willing to lead. The enxt walk is scheduled for 24 September leaving the “Spotted Cow” at 10.00.a.m. – 5.2. miles
2009/8/8 Potterell Charity:- Nothing to report other than all is well.
2009/8/9 Website:- Tom Stone to meet with Councillors Biggin, Bott, Mrs. Bott, Hunt and the Clerk. Date to be arranged. Action - Councillor Hunt
2009/8/10 Holbrook Miners’ Welfare Football Club :- Obscene language during football matches and training sessions does not fall within the remit of the statutory nuisance provisions of the Environmental Protection Act 1990. A.V.B.C. has, however, written informally to the Club to ask that they take all reasonable measures to minimise the problem. It was agreed we should write again and if the bad language persists we should write to the F.A.

2009/8/11 Various Highway Matters- D.C.C. has written to the land owner for the eastern side of Portway regarding vegetation and also the Centre for Autism, similarly they have spoken to Mr. Langton who will cut back the overgrowth on the lower part of Portway as soon as possible. Letters have been sent to both
farm owners in respect of the washdown and also work instruction sheet has been issued to cut back the weeds/vegetation on Shaw Lane. Fingers on signpost opposite Chapel Street readjusted.
8. NEW ACCOUNTS FOR PAYMENT (agreed)
The Accounts Book, Bank Statements etc. were available for inspection.

9. NEW PLANNING APPLICATIONS
1. Proposed certificate of lawfulness for the purpose of constructing a detached
garage and hard standing – 26A, Belper Road, Holbrook – permitted.
2. Fell Horse Chestnut tree – Holbrook Football Club – Makeney Road –
permitted
3. Crown thin oak tree 27, Bradshaw Drive – handed to Councillor Bott to look
at.
10. NEW CORRESPONDENCE
1. Various DALC circulars etc. forwarded by e-mail or circulated in folder.
11.Any Other Business
1. Holbrook sign on Belper Road turned round – Councillors Biggin and Bott to change. Action – Councillors Biggin and Bott
2. Parish Warden has done a good job clearing the gutters on Belper Road, ask D.C.C. to spray with weedkiller. Action – The Clerk
3. “Gorsey Piece” was cut early in July needs cutting again as soon as possible. Paths to be cut later by working party. Action – The Clerk
4. “Knappers Bays” at Coxbench overgrown – working party needs to be arranged.
5. Makeney Road new barns – are they as planning permission? Councillor Hall had spoken to A.V.B.C. Enforcement Officer who confirmed they are.
6. Makeney Road – weeds, nettles etc. overhanging new pavement. Write to D.C.C. thanking them for the seats and asking them to regrade, making it easier to maintain. Action – The Clerk
7. Parish Warden – confirm he is to continue at the end of the year –

8. Annual Footpath Walk report ready within next 2 weeks –

9. Shaw Lane - Six drains in the road five of which need jetting also one at
the bottom of the Nook – inform D.C.C. Action – the Clerk
10. Cinderhill is becoming active again. Reports understood to be held by
A.V.B.C. have not been released. Seepage from tar pits leaking into the
water course.
